Salvatore Ferragamo has filed a case in Delhi supreme court against Metro Brands for allegedly using an omega-shaped logo which is similar to its registered trademark.
Similarly, Paris-based Hermes is fighting a case against Da Milano for allegedly using an ‘H’ logo that’s just like the French luxury company’s trademark. The court had restrained Da Milano from using it.
Ferragamo sells Gancini-branded shoes, belts, socks and bags that bear the symbol representing the Greek letter Omega. within the court documents, the Italian firm said Metro Brands uses a buckle for its DaVinchi shoes that’s “virtually identical” to Ferragamo’s logo.
The Delhi court granted an ex-parte injunction to Ferragamo on December 20 and asked Metro Brands, the parent company of Metro Shoes, to prevent handling products bearing the brand from February 1, 2019.
Ferragamo claims that already a legal notice has been issued to Metro Brands in August 2019. The Mumbai-based shoemaker responded that Metro Brands has not violated any Ferragamo trademark.
Metro Brand’s Trademark Attorneys said that their client doesn’t admit the allegations that they need infringed or have any intention to infringe Ferragamo’s trademark.
“Trademark owners said that their trademarks are already very fashionable and documented amongst the general public at large in India, as stated above and thus it doesn’t require to depend/ride upon the other’s goodwill by infringing other’s trademarks,”.
