Any Company or Organization caught using the Identical or Similar Mark of a Registered Trademark. It is possible that under Trademark infringement, Trademark Owner can file a case. Sometimes, the registrant may lose the infringement case and that mark is considered as Dead Trademark. There are other rules to consider trademark as Dead Mark
A Dead Trademark is available to be claimed by new organization only when no other companies are using it. To make sure a trademark is Dead, we may reach the Registrar and Former Owner of that Trademark to know the things happened before to proceed with the New Trademark Registration Process.
For claiming the Dead Trademarks, Registrant need to Submit the Address details and Dead Mark Name at Registrar of Trademarks to take control of the mark
