As per the rules of Trademarks India, Registered Trademark is restricted from being used by other Companies other than its Owner. People who break the law has to face the Civil Action.
Trademark Owner can File an Infringement Case (Civil Action) in State Court or Federal court, against an Organization which uses the Registered Brands & Logos. This may result in Payable of defendant’s Profit over the Period and pass an order to stop using the trademark.
In the Courts of India, there is an increase in Infringement Cases for every year. It is advisable to get assistance from Registrar to know the use of a Trademark similar or identical to other Companies Brands
