We must opt a trademark very carefully, else the new products or services you’re going to provide to the customers will not be registered if your trademark appears to be a duplicate one.
Most of the owners commit a mistake in choosing similar words, logo, or text unknowingly. Some owners believe that being descriptive about the goods and services in trademark would promote their business to the next level. Even I would agree with that point, for e.g, Kodak film, in this case, a film is descriptive. Descriptive trademarks are difficult to register. Though it would be easy to spread awareness about your goods and services through a descriptive trademark. But it would be difficult to get security because descriptive trademarks come with weak protection. This makes your competitors copy the same trademark.
I would say that your trademark will get a high protection if you choose a new word or arbitrary word. A new word means there is no reference to the goods or services which you provide. For example Samsung, Lacoste.
In arbitrary word type, though it would be a common word, there is no relevance to the goods and services you offer. Example: apple computers, chase bank
If your trademark is completely unique from others, then there will be a scope of getting high security
Tips to choose a trademark :
- Take the help of a trademark attorney to compare the difference between your unique and existing trademarks. Because similarity with existing trademark is not a good sign of trademark.
- Try to avoid using superlative words in trademark eg: Gold, platinum, silver, premium
- Avoid personal Names and surnames in a trademark. Because most of the personal names are common in use.
- As I just mentioned avoid using descriptive words like phones for mobile stores or cooler for refrigerators
- Avoid using words which refers to the quality/product/service/character of the product. Eg: fast cooker, best choice, super comfort
- Avoid using personal names or surnames. Because names and surnames are not unique from registered trademarks.
